Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you", "user") and FinPeek Technologies Private Limited ("FinPeek", "we", "us"). By creating an account or using the FinPeek platform at finpeek.money, including any mobile or web applications (the "Service"), you agree to these Terms. If you do not agree, please do not use the Service.
Please read carefully. FinPeek helps you see and understand your own financial data. We are not a bank, broker, mutual fund distributor, or registered investment adviser. The Service currently provides information, analytics, and educational content — not investment advice or a recommendation to buy or sell any financial product.
1. Who can use the Service
- You must be at least 18 years old and a resident of India.
- You must be legally competent to enter into a binding contract.
- You agree to provide accurate information and to keep it up to date.
- You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.
2. What the Service does
FinPeek is a personal finance platform that helps you consolidate and understand your financial life. Features currently include or may include:
- Aggregating your financial data (bank accounts, deposits, mutual funds, insurance, and similar) through the RBI-regulated Account Aggregator framework, with your consent.
- Displaying a consolidated wealth snapshot across asset classes.
- Providing analytics such as portfolio views, tax summaries, credit bureau scores, and spending patterns.
- Delivering educational content and generic, non-personalised financial nudges.
- Allowing uploads of financial statements (for example, CAMS CAS) to extract holdings.
3. What the Service is NOT
FinPeek provides information and analytics; it does not provide regulated financial services. Specifically:
- FinPeek is not a SEBI-registered investment adviser at this time. Any educational content or nudges are general in nature and not personalised investment advice. If and when FinPeek obtains SEBI Registered Investment Adviser (RIA) authorisation, advisory features will be offered under that registration and governed by separate, additional terms.
- FinPeek is not a bank, NBFC, stockbroker, mutual fund distributor, insurance agent, or loan provider. We do not hold your money, execute trades, or earn commissions on products.
- Any calculations — including tax estimates, returns, credit scores, and projections — are indicative. They depend on the data you share and the assumptions we disclose, and should not be relied upon as professional tax, legal, or investment advice. For specific decisions, consult a qualified adviser.
- Market data, third-party scores, and information from Account Aggregators, bureaus, and other sources are provided on an "as-is" basis and may be delayed, incomplete, or inaccurate.
4. Account Aggregator consent
To aggregate your financial data, FinPeek works with RBI-licensed Account Aggregators. You authorise each data request on the Account Aggregator's interface and can revoke consent at any time. You agree that:
- You will review and approve each consent request carefully before granting it.
- The accuracy and completeness of aggregated data depend on information provided by your banks, asset management companies, and other financial institutions through the AA framework.
- Revoking consent may reduce or disable certain features that depend on that data.
5. Subscriptions and payments
- FinPeek offers a Free tier and paid subscription plans (currently ₹99/month Pro, subject to change).
- Paid subscriptions auto-renew for the chosen billing period unless cancelled before the next renewal date.
- Fees are charged in Indian Rupees and include applicable taxes unless stated otherwise.
- You can cancel a subscription at any time; cancellation stops future renewals but does not entitle you to a refund of fees already paid, except where required by law.
- We may change pricing with at least 30 days' notice by email or in-app. Continued use after the change takes effect constitutes acceptance of the new pricing.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Reverse engineer, scrape, or attempt to extract source code or data from the Service, except as permitted by law.
- Interfere with the Service's operation, security, or other users.
- Upload data that you are not authorised to share.
- Use the Service to build a competing product or dataset.
- Impersonate another person or misrepresent your affiliation with any person or entity.
We may suspend or terminate accounts that violate these rules.
7. Intellectual property
The FinPeek platform, including its software, design, content, trademarks, and branding, is owned by FinPeek or its licensors and protected by applicable intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial financial management. All rights not expressly granted are reserved.
Data you provide remains yours. You grant FinPeek a limited licence to process that data solely to operate the Service and deliver the features you have enabled, as further described in our Privacy Policy.
8. Third-party services
The Service integrates with third-party providers, including Account Aggregators, credit bureaus, payment processors, and cloud infrastructure. We are not responsible for the availability, accuracy, or practices of these third parties. Your use of their services may be subject to their own terms and privacy policies.
9. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, FinPeek disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. You use the Service at your own discretion and risk, particularly for any financial decisions you make based on information shown.
10. Limitation of liability
To the fullest extent permitted by law, FinPeek and its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or investment losses, arising from or related to your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid FinPeek in the 12 months preceding the claim, or (b) ₹5,000.
11. Indemnity
You agree to indemnify and hold FinPeek harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
12. Termination
- You may delete your account at any time from the Service or by contacting support@finpeek.money.
- We may suspend or terminate your account if you breach these Terms, if required by law, or if continuing to provide the Service to you poses a security or legal risk. Where reasonable, we will give notice.
- Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.
13. Changes to the Service and these Terms
We may modify the Service, including adding, changing, or removing features. We may also update these Terms from time to time. Material changes to the Terms will be notified by email or through the Service at least 7 days before they take effect, unless a shorter period is required by law. Continued use after the effective date constitutes acceptance.
14. Governing law and disputes
These Terms are governed by the laws of India. Subject to applicable consumer protection laws, any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra. Before initiating formal proceedings, you agree to first contact us at support@finpeek.money so we can attempt to resolve the matter informally.
15. Data protection & DPDP Act 2023 compliance
FinPeek acts as a Data Fiduciary under the Digital Personal Data Protection Act, 2023 ("DPDP Act") in respect of your personal data. By using the Service, you acknowledge that:
- We process your personal data on the basis of your free, specific, informed, and unconditional consent for the purposes notified to you, or for other lawful uses permitted under the DPDP Act.
- You retain rights as a Data Principal, including the right to access a summary of your data, request correction or erasure, withdraw consent, nominate another person to exercise your rights, and seek grievance redressal.
- Withdrawal of consent will not affect the lawfulness of processing carried out before such withdrawal, and may limit or disable certain features of the Service.
- In the event of a personal data breach likely to cause harm, we will notify you and the Data Protection Board of India in accordance with the DPDP Act.
- Detailed information about how we collect, use, share, and protect your personal data is set out in our Privacy Policy, which is incorporated into these Terms by reference.
16. Grievance redressal
For any grievance regarding the Service or your data, please email support@finpeek.money. A Grievance Officer will be appointed in line with the DPDP Act 2023 and the Consumer Protection Act, 2019, and their contact details published here and in our Privacy Policy. If your grievance is not resolved to your satisfaction, you may escalate to the Data Protection Board of India as provided under the DPDP Act.
